Airbnb sues Anaheim over possible fines from short-term rental ban

Airbnb, a website specializing in short-term vacation home rentals, has filed a lawsuit against Anaheim over fines relating to the city’s recent ban on short-term rentals.

After complaints from residents, the City Council voted last month to phase out short-term rentals.

Airbnb’s issue is the potential fines associated with the ban.   Under the new regulations, the city would require websites, such as Airbnb, to remove any unauthorized listings or face fines ranging from $500 up to $2,000 per violation.

Airbnb claims that they are not responsible for the content of their user’s posts, citing the Communications Decency Act, that makes operators of internet services not legally liable for the words or posts of third parties who use their services.

Airbnb has filed similar lawsuits against the cities of San Francisco and New York.

The City of Anaheim has not commented on the lawsuit.
