
A New York man is suing Walt Disney Parks and Resorts after a 2015 encounter in which he was forced to move out of the parade route in front of Cinderella Castle at the Magic Kingdom.
Mark Rubin, 57, was visiting Walt Disney World with his girlfriend and intended to propose in front of the castle. According to the 24-year-old female Cast Member involved, Rubin was asked to move approximately 3 feet back so that he was out of the parade route. In response, Rubin “screamed in her face and grabbed her.”
The incident report from the Orange County Sheriff’s Office says that “Marc [Rubin] grabbed her shirt collar and threaten[ed] to punch her in the face.”
After a manager arrived, Rubin was taken to the security office, then later arrested by the sheriff’s office. At the time, Rubin plead no contest to a disorderly conduct charge and paid a $100 fine.
Now, Rubin is suing for negligence, saying that the Cast Member falsely accused him of grabbing her. In the lawsuit, Rubin claims that he told the Cast Member he was waiting for the rest of his party and asked for a “brief delay.”
The lawsuit says that she insisted he move immediately and that, while a “verbal altercation ensued,” Rubin didn’t touch the Cast Member.
Rubin is suing for negligence and false imprisonment or arrest. He’s asking the Orange Circuit Court to award more than $15,000 in damages.
