United States District Judge Jeffrey White has denied SeaWorld’s request to dismiss a pending false advertising lawsuit against the company.
The suit was filed by Marc Anderson and three other plaintiffs who believe SeaWorld was not as focused on conservation and animal welfare as they claimed to be. The plaintiffs will now be allowed to refile a more detailed complaint.
Anderson alleges that he purchased tickets and visited SeaWorld San Diego in 2014 based on orca lifespan and breeding information provided on the company’s website. He now believes that the information on the website was not true and says that he would not have purchased tickets had he known the truth.
Another plaintiff purchased a plush Shamu based on what she now believes was misinformation from a SeaWorld trainer regarding the whales’ collapsed dorsal fins.
Three other false advertising or deceptive marketing lawsuits against SeaWorld were dismissed in December.
SeaWorld has not commented on the current lawsuit.
